1. Acceptance of Terms

By creating an account or using RimoRosh, you agree to these Terms of Service.

2. User-Generated Content

• You are solely responsible for the content you post.
• Content that is offensive, abusive, harassing, illegal, or otherwise objectionable is strictly prohibited.

We have ZERO TOLERANCE for:

• Hate speech or discrimination
• Violence or threats
• Sexual content involving minors
• Illegal activities
• Harassment or bullying
• Spam or malicious content
• Copyright infringement

3. Content Moderation

• We do not review content before it is published.
• We act on user reports. Every report is reviewed, and we aim to respond as quickly as we reasonably can.
• Violating content is removed once identified.
• Repeat offenders are banned permanently.

4. User Responsibilities

• You must be 18 years or older to use this app.
• You are responsible for your account security.
• You agree not to impersonate others.

5. Reporting & Blocking

• You can report any post, comment, or user.
• You can block abusive users.
• Blocked users cannot see your content or contact you.

6. Connect

Connect is an optional feature that places you in a live video call with another RimoRosh user chosen at random. The call begins immediately once a match is found, and you do not choose who you are matched with.

• Age requirement:
  • You must be 18 years or older to use Connect.
  • You confirm your age once before your first call.
  • We rely on the age you confirm. Giving a false age is a violation of these Terms and may result in permanent termination of your account.
• What happens during a call:
  • Your live camera and microphone are transmitted to the other person for the duration of the call. The call is not recorded or stored by RimoRosh.
  • You can turn your camera or microphone off at any time during the call, and the other person then sees a black screen.
  • Text messages sent inside a call are shown only during that call and are not stored.
  • You can skip to another person or end the call at any time.
• What is not allowed:
  • Nudity, sexual acts or sexual content of any kind.
  • Any content involving a minor.
  • Violence, threats, hate speech, harassment or discrimination.
  • Advertising, soliciting money, or directing people to external services.
  • Appearing on camera while impersonating someone else.
  • A single violation is enough for permanent termination of your account.
• Reporting and blocking:
  • You can report or block the other person at any moment during the call, from the menu at the top of the screen.
  • Blocking ends the call immediately and moves you to another person. A blocked user cannot be matched with you again, cannot see your content and cannot contact you.
  • Reports are reviewed as quickly as we reasonably can.
• Your responsibility and our limits:
  • RimoRosh does not verify the identity, age, background or intentions of any user.
  • We do not perform criminal background checks.
  • Calls are live and we cannot review them before they happen. We act on reports after the fact.
  • Everything you show or say on camera is your own responsibility, and you may be seen by a person you have never met.
  • To the fullest extent permitted by law, RimoRosh accepts no liability for any loss, injury or damage arising from a call between users. This does not limit liability that cannot be excluded under German law, including liability for intent, gross negligence, or injury to life, body or health.
• Safety advice:
  • Never show your face or surroundings if you are not comfortable being seen by a stranger.
  • Do not share your full name, home address, workplace, phone number, bank details or identity documents.
  • Never send money or gift cards to someone you met in Connect.
  • End the call and report immediately if the other person shows anything illegal or makes you uncomfortable.
• Country servers and gifts:
  • The monthly Connect subscription lets you choose a specific country server. The global server is free for everyone.
  • Subscriptions and gifts sent during a call are not refundable. See the Payment Terms of Service for the full refund policy.

7. Discover

Discover is an optional feature that shows you profile cards of other users and lets you like or skip them. A private chat opens only when both people have liked each other.

• Age requirement:
  • You must be 18 years or older to use Discover.
  • You confirm your date of birth before you can enter the feature.
  • We rely on the date of birth you provide. Giving a false date of birth is a violation of these Terms and may result in permanent termination of your account.
  • Discover is not available to accounts whose recorded age is under 18.
• Your information in Discover:
  • You are responsible for the accuracy of everything you enter, including your photos, your description, your city and your gender.
  • Your name and profile photo are taken from your RimoRosh account and are shown on your card.
  • Photos you add to your card are copied into Discover. Deleting the original post does not remove the copy from your card.
  • You may switch your visibility off at any time. Your card is then hidden from other users and your photos remain stored so that the card is intact if you switch it back on. Deleting your RimoRosh account removes your Discover profile, photos, likes and matches permanently.
• Meeting other people:
  • RimoRosh does not verify the identity, age, background or intentions of any user.
  • We do not perform criminal background checks.
  • Any contact, communication or meeting with another user, whether inside the app or in person, is entirely at your own risk and your own responsibility.
  • RimoRosh is not a party to any interaction between users and is not responsible for the conduct of any user, online or offline.
  • To the fullest extent permitted by law, RimoRosh accepts no liability for any loss, injury or damage arising from contact between users. This does not limit liability that cannot be excluded under German law, including liability for intent, gross negligence, or injury to life, body or health.
• Safety advice:
  • Never send money, gift cards or financial details to someone you met in Discover.
  • Do not share your home address, workplace, bank details or identity documents.
  • If you meet someone in person, meet in a public place and tell someone you trust where you are going.
  • Be careful with anyone who avoids video or voice contact, who asks you to move to another platform quickly, or who asks you for money for any reason.
  • Report and block anyone who makes you uncomfortable. You can do this from the card itself and from the "Liked you" list. A blocked user cannot appear to you or contact you.
• Discover subscription and gifts:
  • The monthly Discover subscription reveals the full list of people who liked you. It does not create matches and does not open chats.
  • Liking, skipping and matching are free for everyone.
  • Subscriptions and gifts sent through Discover are not refundable. See the Payment Terms of Service for the full refund policy.

8. Account Termination

• We reserve the right to terminate accounts that violate these terms.
• You can delete your account at any time from Settings → Account Info.

9. Intellectual Property

• You retain ownership of content you post.
• You grant RimoRosh a license to display and distribute your content within the app.
• Do not post copyrighted material you don't own.

10. Disclaimer

• RimoRosh is provided "as is" without warranties.
• We are not liable for user-generated content.

11. Changes to Terms

We may update these terms. Continued use means acceptance of changes.

Payment Terms of Service

By using RimoRosh's Stars and Gift features, you agree to the following terms governing payments, withdrawals, and financial transactions.

1. The Stars System

RimoRosh uses a virtual currency called Stars (⭐). The system works as follows:

• Users purchase Stars with real money via Apple In-App Purchase (iOS) or Stripe (Android)
• Stars are stored in your in-app wallet
• Stars are used to send gifts to other creators (e.g., 🌹 Rose = 1 ⭐, 🏰 Castle = 1,800 ⭐)
• Stars received as gifts arrive as Stars, not as cash. They can be spent inside the app, sent onward as gifts, or — if you meet the withdrawal conditions in section 7 — converted to EUR and paid out

2. Stars Packages and Pricing

Star packages range from 2.99€ to 249.99€, displayed clearly before purchase:

Prices shown include VAT where applicable. The VAT rate depends on the buyer's country and is collected and remitted by Apple or by RimoRosh, depending on the platform.

3. Nature of Stars and Virtual Gifts

By purchasing Stars or sending gifts, you acknowledge that:

• Stars are digital virtual currency. The price paid to buy a Star and the amount paid out when a Star is withdrawn are two different values, and the withdrawal value is lower
• Stars purchased by you are non-refundable and cannot be converted back to cash by the purchaser
• Stars do not grant ownership rights, intellectual property, or any tangible goods
• Gifts sent to creators are voluntary expressions of appreciation, not payment for services
• Sending a gift does not create any service contract with the recipient

4. Gift Value and Withdrawal Rate

When you send a gift, the full number of Stars is transferred to the recipient. No fee is deducted at the moment of gifting.

RimoRosh's revenue is realised at the moment Stars are purchased, not when they are given away. The difference between the purchase price of a Star and its withdrawal value covers Apple's or Stripe's fees, VAT, and RimoRosh's own costs and margin.

Example: a user buys the 19.99€ package and receives 335 Stars. They send a 🎂 Cake (30 ⭐) to a creator. The creator's wallet gains 30 Stars, worth 0.53 € if later withdrawn.

The Star balance and its EUR value are both shown in your wallet at all times.

5. No Refund Policy

All Stars purchases and gift transactions are final. By completing a purchase:

• You will not receive a refund under any circumstances except as required by applicable law
• For iOS purchases, refund requests must be made directly to Apple via your Apple ID account settings: reportaproblem.apple.com
• For Android purchases via Stripe, contact our support team within 14 days
• Chargebacks initiated through your card issuer may result in permanent account suspension
• Disputes must be resolved directly with the recipient when applicable

This policy exists because:

• Stars are immediately credited to your wallet upon purchase
• Gifts are immediately credited to recipients when sent
• Digital goods cannot be "returned"
• Creators may rely on received funds

6. Creator Wallet and Earnings

When you receive gifts as a creator:

• The Stars are credited to your in-app wallet
• Your wallet shows both the Star balance and its EUR value at the current withdrawal rate
• Stars remain in your wallet until you spend them or request a withdrawal

Minimum withdrawal: 10.00€

7. Withdrawal Eligibility

To request a withdrawal, you must meet all of the following:

• Minimum 1,000 followers on your RimoRosh account
• Minimum withdrawable value of 10€ in your wallet
• Verified account (email or phone)
• Connected Stripe Connect account (for bank transfers)
• No active violations of our Community Guidelines

These requirements exist to prevent fraud and money laundering, ensure genuine community engagement, comply with anti-spam regulations, and maintain platform quality.

If you do not yet meet these requirements, your Stars remain safely in your wallet until you do.

The amount shown as withdrawable in your wallet is the amount that reaches your bank account. RimoRosh deducts no further fee at withdrawal.

8. Withdrawal Methods

Withdrawals are processed via Stripe Connect for security and compliance. For countries not supported by Stripe, contact us at supportrimorosh@gmail.com for alternative arrangements.

9. Identity Verification (KYC/AML)

To comply with anti-money laundering (AML) and Know Your Customer (KYC) regulations, Stripe Connect requires:

• Government-issued photo ID
• Proof of address
• Tax identification number
• Additional verification for withdrawals exceeding €1,000

This verification is handled directly by Stripe during the onboarding process. Failure to complete verification may result in withdrawal delays or account suspension.

10. Tax Obligations

You are solely responsible for:

• Reporting received gift income to your local tax authority
• Paying any applicable income tax, VAT, or other taxes
• Complying with self-employment regulations in your jurisdiction
• Maintaining your own records for tax purposes

RimoRosh provides transaction history but does not issue tax forms. We recommend consulting a tax professional regarding your specific situation.

For German users: Gift income may be subject to Einkommensteuer (income tax) and potentially Umsatzsteuer (VAT) if you exceed the Kleinunternehmer threshold (€22,000/year).

11. Account Limits

• New accounts may have lower transaction limits
• Limits increase based on account age and verification status
• Suspicious activity may trigger temporary restrictions
• We reserve the right to refuse transactions

12. Prohibited Uses

You may not use the Stars or gift system to:

• Launder money or finance illegal activities
• Evade taxes or financial regulations
• Pay for illegal goods or services
• Circumvent platform fees through external arrangements
• Send gifts as payment for services performed off-platform
• Engage in any form of fraud or manipulation
• Resell Stars or trade them outside the app (Stars may only move between users as gifts inside RimoRosh)

Violations will result in immediate account termination and forfeiture of the Star balance.

13. Fraud Prevention

RimoRosh monitors all transactions for suspicious activity. We may:

• Hold funds pending investigation
• Request additional verification
• Suspend accounts under review
• Cooperate with law enforcement when required
• Reverse fraudulent transactions when possible

14. Disputes and Chargebacks

If you initiate a chargeback through your card issuer or Apple:

• Your account will be immediately suspended pending investigation
• You may be permanently banned if the chargeback is found to be fraudulent
• You remain liable for chargeback fees imposed by payment processors
• The recipient's wallet may be debited for the disputed amount
• Future purchases from your payment method may be blocked

15. Service Changes

We reserve the right to:

• Modify Star package contents and prices with 30 days notice
• Add or remove payment methods
• Adjust the EUR withdrawal rate for creators, with 30 days notice
• Change withdrawal minimums or processing times
• Update these terms (continued use constitutes acceptance)

Changes to the withdrawal rate apply to future withdrawals. Stars already in your wallet keep the Star count you were given.

16. Termination

In case of account termination:

• Unused Stars are forfeited and not refunded
• Pending withdrawals will be processed only if compliant with our policies
• The Star balance may be forfeited if termination is due to violations
• Transaction history is retained as required by law
• You remain liable for any outstanding obligations

17. Limitation of Liability

RimoRosh is not liable for:

• Indirect or consequential damages from Stars or gift transactions
• Losses due to payment processor outages (Apple, Stripe)
• Delays caused by third parties (banks, payment providers)
• Tax consequences of received gifts
• Loss of Stars due to account suspension or termination

Our maximum liability is limited to the amount RimoRosh retained from the disputed transaction.

18. Apple-Specific Terms (iOS Users)

• All Stars purchases are processed exclusively through Apple In-App Purchase
• Apple's standard terms apply: apple.com/legal/internet-services/itunes
• Apple is not a party to these terms but acts as the merchant of record
• Apple may enforce its own refund policy independently of RimoRosh's policy

19. Governing Law

These payment terms are governed by the laws of the Federal Republic of Germany. Disputes shall be resolved in the courts of Mainz, Germany, unless mandatory consumer protection laws apply in your country of residence.
